			<content:encoded><![CDATA[<p>Why does a bank go thru the Trustee Sale when they have a buyer and loan ready to fund? Is there NO communication between the departments? Why not put out a HOT list to investors of sales occurring in the next 2 weeks that will NOT go to sale if qualified good offer is made? A last minute Sale -sale on a home that didn&#8217;t sell. Win-Win A coordination with listing broker, negotiator and foreclosure dept. Unless the banks like to have houses sitting empty getting vandalized, landscape dying, that will cost them more money to hold, fix  and re-list, I don&#8217;t see why this occurs.  </p>

<p>I can fund a hard money loan in a week. I can approve in a day or two. However twice now the house sold in Trustee Sale a day or two before funding. That is crazy. The listing broker said we can get extension, no problem. Oops, went to sale. Then, you would think you should still put the approved sale thru as REO, but no, back to the who knows where it goes. &#8221; Lets see how long we can delay this sale&#8221; says someone in that crazy banker process. Lets evict and let the home deteriorate. Then no conventional financing will work, only hard money lenders will fund it. Do they have another housing debacle plan up their sleeves? Maybe they are going into the Real Estate business, just send congress a check to get that ok&#8217;ed. They are not making loans. Maybe they are going into the hard money business.. They have gotten regulations passed so that  a large percentage of mortgage brokers are out of the business. They could be retail &#8220;hard money lenders&#8221; now.  Perhaps &#8220;put your home purchase on our new credit card,&#8221; then they can charge whatever rate they want. OK I will stop .Seriously though, what business are the banks in. I just see credit card ads. Since you will pay to use your own money on a debit card now&#8230;&#8221;We can get the consumer to use credit cards&#8221; then we can rake in the money and totally annihilate the middle class thru more debt at high interest rates again. Oh I see, credit cards are bankers way of getting into  &#8220;hard money&#8221;, without the DRE and Federal regulations. 			<content:encoded><![CDATA[<p><span style="font-size: small;">So, how do you qualify for </span><span style="font-size: small;">a hard money loan?Truth be told, <em>you</em> don&#8217;t. The property is or should be 99% of the underwriting criteria.  Investors lend on property that has plenty of a protective equity left  after funding the loan.</span></p>
<p><span style="font-size: small;"> Asking for 100%  financing ,for say an REO purchase money loan ,is something to ask your uncle. Investors look a profit and  risk, the same as a buyer does.You offer 12% 2 pts so you can buy and  flip a property in say 60 days and make 25% 30%..profit.That leaves the  lending investor a whopping 2%, and he put up all the money and takes  all the risk. That is why that concept doesn&#8217;t work. Also, future value  after rehab, would be taking the risk that the work may not be done. So  As-is value is looked at much closer. </span></p>
<p><span style="font-size: small;">Investors like to be 55-60% of value. If you can&#8217;t come in with all the cash balance needed their are other ways. </span></p>
<p><span style="font-size: small;">If  you own another  property with equity that could  be borrowed  in conjunction with the purchase, a blanket loan, also a seller carry back.  However, the investor has to feel comfortable you have enough &#8220;skin in  the game&#8221; so if the going gets tough you don&#8217;t walk away and leave him  the problem. </span></p>

I have caught many errors over the years. Real Estate crime has gone wild. The DA&#8217;s office is  overwhelmed.<span id="more-503"></span></p>

I contacted the DA&#8217;s RE fraud dept. I was told because the &#8220;seller&#8221; was deceased( <span>prior</span> to the quit claim deed execution) there was no victim. The criminals could of been caught with check in hand and arrested, but I couldn&#8217;t get a detective interested. We just canceled the loan requested. The broker who sold the previous Trust Deed wasn&#8217;t interested either. He told me he will just sell in a Trustee Sale, his investor will be paid and nothing will happen. The last title company who insured the transfer, never returned my call after informing them of the fraud.  So the criminals will move on to the next victim, a Trust Deed Investor or buyer or homeowner or a bank. There wil be another <strong>Trust Deed Investment Scam. </strong></p>
<p>What could of been done to prevent that?</p>
<p>In the above  case, there is an affidavit the Title company is suppose to request when a Title is transferred without prior Title Insurance. The seller is to sign yes- in fact he transferred the property. He did in fact sign the deed. In the above case they didn&#8217;t ask for it, even though the red flags were waiving. Elderly person quit claims to a non- relative on a free and clear property. He forged the quitclaim. The recorders office will record anything signed with a notary stamp. When it  went to assessors office to change ownership, there was a note, &#8220;dead women came alive&#8221; need to investigate. However they did <span>not pull it </span>but let it go through and changed the title to the new owner.The new &#8220;owner&#8221; then gets an all cash out loan, on stolen property. This is an example of the dangers to avoid when investing in Trust Deeds.</p>
<p>I have heard of many different cases involving <strong>fraud with</strong> <strong>Trust Deed Investments </strong>this year that could of been prevented. You need to make sure your Hard Money Broker cares enough to do his due diligence and be aware of the situations where criminals can enter your life. Regarding your Trust Deed Investment&#8217;s safety-the Title company who made the error, will <em>probably</em>, eventually, (year or so) pay the claim. However  you lose interest and all the stress and time of dealing with the situation.</p>

Another warning, the forged notaries, that is another story&#8230;.Something can be done about this though; prevention is worth a pound of cure. You need that variety of individual investors, to have a successful close, and to find the right hard money lender in Calif.  You may also be  adding  costs by paying more than one broker.</p>

Too bad wall street didn&#8217;t know how to underwrite safe investments for the  sub-prime loans, they stole from the small private investors, of the 80&#8242;s. Personally I would rather collect checks than deal with the real estate and tenants etc. We sell our Trust Deed Investments  as fast as they come in. <p>These are usually cash out refinances. Purchase money loans for borrowers who have 50% cash downpayment.  Mainly 1st Trust Deeds. We do have requests for 2nd Trust Deeds for smaller amounts. As long as the first is not too large and LTV is @50% these are attractive also. Request are for 1-5 years interest only. $50,000 &#8211; 3M+</p>

<p>This due to wanting to avoid a broker to broker chain, or not knowing if you are talking to a knowledgeable underwriter for the investor or just another broker who wants to shop your loan around town. He may have good connections with hard money lenders and could co-broker with you ,if you don’t know where to go. If that is not what you want,then you need to ask a few questions. Be aware of some signs that you are not with a direct hard money lender, or an actual hard money lender at all.</p>
<p>Before I get into that, lets define, hard money lender, private money lender. As these terms have been abused  a lot in the last few years in the hard money arena. Advertisers don’t always truly represent what they really are. (I&#8217;m sure you&#8217;ve never experienced that) Before B,C, loans were sold to wall street in the 80&#8242;s a borrower with bad credit had only one place to turn, to a hard money lender.(Now they are coming back)</p>
<p>Hard Money defined: To turn an asset into hard cash( nickels and dimes). Private investors would look for a property that had  good equity position for his collateral.<br />
Loan to Value range, 60-65%. They go an look at the property.<br />
Investors would look to see if the borrower could make the payments or had a<br />
plan to use reserves from the loan to buy time to sell. If it is a commercial building,<br />
he would look to the actual or projected income to see if that would  debt service the loan.</p>
<p>Some signs you are not with a hard money, private investor source:</p>
<ul>
<li>National Lender: No one has investors in every state.</li>
<li>Package required: Tax returns, Financial Statements, MAI appraisals, not a private investor requirement.</li>
<li>Approval: It only takes days for a decision to be made.</li>
<li>Loan Amounts: up to 100M, no single investor is going to write that check.</li>
<li>There is alot more but I hope those help cut down your shopping time.</li>

There is a lot of hard money available, for the better borrowers, who happen to need hard money now.  This due to the tightening credit crunch the banks are dealing with. These can close within 10 days. Fast approval. So if you need large hard money loans at low rate give us a call.</p>

I look at my stock portfolio and find it takes a lot of effort to remain the optimist. My trust deed investments are a calm in this storm. However just as one picks good and bad stock, you may have some trust deed investments that are not trouble free. Although I personally never lost money on any.<span id="more-15"></span></p>
<p>We pride ourselves in choosing safe trust deed investments. As we have seen in the past the residential market is more volitle. You need to be conservative on Loan to Value  ratios, and know that individual situations can change radically. Collateral, Collateral, Collateral. That is where the banks error. Good job, good credit today, can be gone tommorrow. (Or Falsified)</p>
<p>We have leaned toward income property, commercial trust deeds investments,these have far more stability and are a safe trust deed investment. Again, low Loan to Value is key.</p>
<p>They just don&#8217;t have the high default rate. Also, investing in trust deeds in areas familiar to you are safer. All our investors inspect the property first hand. We supply comparable sales from unbiased, reliable public records. We try and send those trust deed investments in the same area the investor lives. A self-directed IRA is a great way to invest in real estate and safe trust deed investments. That can be a great tax advantage, while your money grows. Discuss that with your accountant of course.</p>
